 Art. 13 and 14 of  Regulation (EU) 2016/679

In compliance with articles 13 (for data collected from the Data subject) and 14 (for data not collected from the Data subject) of Regulation (EU) 2016/679 (GDPR) the following information is provided to the Users of this Website; it refers exclusively to the processing carried out through said Website and not through other Websites that may be visited through links present in said Website, for which it is recommended to read the relative information given by the respective Data Controllers.

O.M.A.S. S.r.l., with registered office in: Agna (PD), Via Pietra n. 73, Tax code and VAT number: 03867820288, telephone: +39 049 538178 fax +39 049 9515358, e-mail: info@omas-metal.com. The Data Controller reserves the right to appoint a web agency as Processor of personal data processed for the purposes of technical support, maintenance, technical management and the like on this website, whose details may be disclosed following a request made to the aforementioned addresses.

The Data controller and the Processor may enlist the help of employees to process Users’ data: such officers are purposefully appointed and instructed on how to correctly process personal data, even verbally.

The personal data of the Website Users, as described above, will be processed in the forms and manners provided for by the GDPR for purposes related to the Website, particularly (but not exclusively) with regard to the procedures described therein on data collection, contact forms and access to the reserved area.

More specifically, the personal data communicated to the Data controller will be processed for the following purposes:

– to follow up on the specific requests sent to the Data Controller from the User through the Website and its communication tools (contact forms, information request forms and the like);

– for subscription to newsletters and subsequent communications and information relating to the sector in which the Data Controller operates, with appropriate consent given by the User by ticking the appropriate box;

– for other accessory purposes or for purposes connected to those indicated above and in any case falling within the scope of the Website activities;

– for the processing of the e-mail address provided by the Data subject for purposes that fall within the scope of the Data Controller activities. In any case, the Data subject may express their rejection of and oppose such processing, both at the beginning and at a later date, by following the instructions in each subsequent communication; such procedure shall be easy to carry out and free of charge.

The processing of general data will be performed even following automatic collection during navigation, for the sole purpose of verification and control of accesses to the Website. This also applies to any technical cookies, that is session cookies, functionality cookies or analytics cookies that meet the requirements specified by the Authority. In particular, with regard to the latter, it is hereby clarified that such cookies can be assimilated to technical cookies where these are generated and used directly from the Website. In any case, for said cookies analytics, following the clarifications of the Authority, the Website has provided for the anonymization of IP addresses; the collection and use of the aforementioned navigation data allow monitoring the performance of the Website and make it possible to improve the service rendered, offering the User a better navigation experience. Please refer to the appropriate cookie Policy for more information.

The processing of personal data is based on the right to information, on the fulfilment of contractual obligations or social contact, or where necessary, on the consent given through the free and conscious filling out of the fields in the dedicated form.

The processing of personal data is also based on the legitimate interests of the Data Controller, such as the exercise of the rights within the context of information society and the execution of the contract.

The provision by the Users of data relating to navigation, for the aforementioned purposes, depends on the privacy level set by Users in their browsers. In some cases, disabling could impair Website navigation. For certain modules of this Website, navigation data and/or the use of cookies is needed for the proper functioning of the Site.

In any case, some personal data are necessary for the structure of the website and its procedures. In particular, but not limited to:

– sending messages via contact forms or subscribing to newsletters require the provision of the minimum data listed therein, such as the USERNAME and/or the name/surname and/or email address and/or other data that identify the sender;

– the USERNAME and PASSWORD are required for registering and accessing the reserved area of the Website. If such data are not provided, the procedure will not be successfully completed.

Any request for other optional data will be preceded by a special approval check.

The provision of any other information is optional, in accordance with the type of information the Users want to give the Website.

Failure to provide compulsory personal data prevents the Data Controller from sending communications from the Company.

The personal data may be shared with connected companies, subsidiaries and associates as well as with consultants or thirds that carry out some activities relating to the purposes indicated in this policy, also on behalf and in the name of the Data Controller; such entities may be both intra-EU and non-EU (in the latter case only those who have subscribed to the Privacy Shield protocol may receive the information).

Navigation data and similar data (for which reference should be made to what is mentioned above), as well as third party profiling cookies (for which reference should be made to the Cookie Policy of this Website), will be communicated to the interested third parties, where they are not processed directly by the same in their capacity as Data Controllers.

The data provided by the Data subject will be kept until withdrawal is expressly required by the same or at least for the duration provided for by the GDPR, the applicable national legislation or the provisions of the Authority in relation to particular processing operations.

Pursuant to articles from 15 to 22 of the GDPR, each Data Subject shall have the right to access, rectify, erase (right to be forgotten) and be notified in case of modification, cancellation or restriction; they shall also have the right to data portability, the right to object and to not be the subject of an automated individual decision, including profiling.

These rights can be exercised in accordance with the forms and terms of art. 12 of the GDPR, by way of an email sent to the Data Controller at the following addresses  info@omas-metal.com

The Data Controller will respond as soon as possible and in any case within 1 month from receipt of the request.

The consent to data processing may be withdrawn at any time by

  • sending an email to the Data Controller at the following addresses:  info@omas-metal.com ;
  • express communication at the address of the Data Controller.

Pursuant to art. 77 and articles thereafter of the GDPR, each Data subject has the right to lodge a complaint with a supervisory authority: for Italy, such authority is the Data Protection Authority.

The manners, procedures and terms for such complaints are provided for and regulated by the current national laws.

The complaint is without prejudice to the administrative and judicial actions, which, for the Italian State, may represent an alternative to the same Authority or to the Competent Court.

Personal data provided with this form will not be subject to profiling.
